would the aimshot 3500 be effective for finding a live raccoon that is hiding in a 40 foot leafy oak tree in 40degreeF or less temperatures ?

No, no heat seeker will even come close to that job. That job would even be a challenge to a $6000 thermal imager due to the intervening foliage. Save your money and look for another solution.
