Export Restriction FAQ
It is our goal to make the order process as smooth as possible. In general, an "export" includes any shipment from the United States to a foreign destination, but it also includes much more than this simple explanation. Among other things, an export includes orders to APO/FPO destinations.
We understand that any delay in your order can be frustrating, but exports are subject to complex regulations and it is essential that regulated products are treated properly. This step in the process is important and, ultimately, these regulations are burdens we all share together. We apologize for any inconvenience you may experience due to export related delays or cancellations.

Yes, we do ship to deployed soldiers at APO/FPO addresses and we are proud to provide the U.S. Armed Forces with the gear they need to get the job done and come home safely.
As these orders are considered exports, we may not be able to ship certain products due to U.S. export laws and regulations. We understand that this can be frustrating and that any order delays or cancellations can cause an unwanted inconvenience.

The U.S. Government decides which items are restricted for export and the reasons behind those decisions can be complicated. Certain items are restricted for export and may require proper authorization or license from the U.S. Government prior to export.

Many high-tech, advanced and inherently dangerous products are restricted for export. Additionally, the U.S. Government has identified products that are restricted for export for a number of different reasons. These restrictions, are set by the U.S. Government, and are something we all have to abide by.

The product is regulated by the International Traffic in Arms Regulations (ITAR), and export is strictly prohibited without authorization or a license issued by the U.S. Department of State's Directorate of Defense Trade Controls.
By proceeding with a transaction to purchase any restricted item(s), the Customer certifies that:
(i)The purchase does not require OpticsPlanet, Inc. to export such items;
(ii)The Customer does not intend to export such items after receipt from OpticsPlanet, Inc. without the appropriate U.S. Government export authorization;
(iii)The Customer does not intend to export, transfer, sell, or furnish the item to any foreign person, whether abroad or in the United States, including any Foreign Embassy in the United States without the appropriate U.S. Government export authorization;
(iv)The Customer understands that a foreign person under the ITAR § 120.16 means any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3), and can mean any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the United States, as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions).
The Customer certifies that the Customer is a U.S. Person as defined by ITAR § 120.15, meaning the Customer is a lawful permanent resident of the United States, as defined by 8 U.S.C. § 1101(a)(20), or is a protected individual as defined by 8 U.S.C. § 1324b(a)(3), or is a corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the United States, or is a governmental (federal, state, or local) entity.

The product is regulated by the Export Administration Regulations (EAR), and export is restricted by the U.S. Department of Commerce's Bureau of Industry and Security.

Due to the highly technical nature of the products we sell and the complexity of government restrictions for some products, we occasionally require customers to provide additional documentation. Common restrictions for products are those that can only be sold to Military, Law Enforcement and/or other qualified personnel.
Additional documents assist in confirming the customer's eligibility to purchase certain items. This also helps to make sure that specialized products do not get into the wrong hands. Common supporting documents include purchase orders on department letterhead and other documentation. We do our best to keep customers informed of the requirements through special messages placed on product pages such as the following:

Restricted Party FAQ
It is our goal to offer the most advanced, specialized and technical products to our customers. Due to U.S. laws and regulations, we screen several lists of individuals maintained by the U.S. Government, such as: the Denied Persons List, the Unverified List, the Entity List and the Specially Designated Nationals List, among others.
On occasion a customer's name may match to a name on these lists and many common names experience this issue. This is, of course, an inconvenience and we strive to make sure any such issues are resolved promptly, with minimal impact on your order. In such cases, we must take the proper steps to confirm the correct identity.
We appreciate your cooperation and understanding in this process. Our Risk Management team will work to communicate and assist you with resolving these issues in a timely manner.
