can this be used on a .38 spl

The JP Enterprises JPoint 8 MOA Reflex/Red Dot Sight could be used on a 38 Special as long as it can be mounted properly. Whether or not there is a compatible mount will depend on the specific gun.

Will this fit a Kahr cw9? Can I mount it to the dovetail after removing the rear sight?

Unfortunately, I do not see anyone that makes a model to fir the rear sight dovetail on your Kahr.

It should however will be noticeably wider than the slide. The Shield RMSc would be a better fit:
