Which ring mount height for a 3-9x40 scope?

Normally, a 40mm objective lens will require a set of low height rings to mount the scope as close to the receiver as possible on bolt guns. AR platform rifles should use extra-high rings regardless of the lens size. Will the extra high rings clear a Magpul MBUS rear sight?

The MBUS is very close to the saddle height of these extra high rings, so it will only clear if the ocular lens is past the MBUS sight.
