Broke before i ever got to use it - BOG Death Grip Clamping Tripod

so the legs broke while in the 85 setting. everything was fine till I set my 16LB precision rifle into the clamp then I noticed the legs sag down till the bottom of the center column was touching the the ground. I noticed 2 of the legs did not lock into the 85 position and were folding up under the weight of the gun. I took the gun off and inspected the tripod and found cracks forming on the top of the legs. I decided to return this as I would not trust it to hold my firearm. If cracks were forming on the legs with the gun just mounted i imagine it would break one I started shooting.
