No, Optics planet most likely has an agreement with EOtech that states they can only sell to Military or LE if it’s in connection with their duties. However there are other companies that do sell quad-tube gen 3 NVGs on the civilian market.

These are far from fragile. The units are made of metal that has a high impact rubber/polymer overmold designed and engineered for these goggles.
